1. Acceptance of Terms

By accessing or using Enkidu, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service.

2. Description of Service

Enkidu is a social connection service that helps users discover activities, connect with others, and foster meaningful relationships. We provide features including but not limited to:

  • User profiles and matching
  • Activity discovery and proposals
  • Chat and messaging functionality
  • Growth tracking and insights
  • Location-based recommendations

3. User Accounts

3.1 Registration

You must create an account to access certain features of our service. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Eligibility

You must be at least 18 years old to use our service. By creating an account, you represent and warrant that you meet this age requirement.

4. User Conduct

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable laws
  • Harass, abuse, threaten, or intimidate other users
  • Post or transmit any content that is harmful, offensive, or inappropriate
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the service or servers or networks connected to the service
  • Attempt to gain unauthorized access to any portion of the service
  • Use automated systems or software to extract data from the service
  • Share or sell your account credentials

5. Content

5.1 User Content

We retain ownership of any content you submit, post, or display on or through the service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, publish, transmit, and display such content in connection with providing the service.

5.2 Content Moderation

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, but we have no obligation to monitor or moderate user content.

6. Safety and Privacy

Your safety is important to us. We provide features to help you stay safe, but you are responsible for your own safety when meeting people or attending activities. Always meet in public places and inform someone you trust about your plans.

Our collection and use of personal information is described in our Privacy Policy. By using the service, you consent to our collection and use of personal information as outlined in the Privacy Policy.

7. SMS/Text Messaging Terms

7.1 Program Description

Enkidu offers an SMS/text messaging program through which you may receive automated recurring promotional and informational text messages, including but not limited to match notifications, activity reminders, account alerts, and promotional offers. Messages may be sent using an automatic telephone dialing system or other technology. Message frequency varies based on your account activity and preferences.

7.2 Consent

By opting in to our text messaging program, you expressly consent to receive recurring automated promotional and informational text messages from Enkidu at the mobile number you provide. You understand that consent is not a condition of purchasing any goods or services from us. You may opt in through our website, mobile application, or by other means we make available.

7.3 Message Frequency and Rates

Message frequency varies. Message and data rates may apply depending on your mobile carrier plan. You are solely responsible for any message and data charges from your mobile carrier. Check with your carrier for details on your messaging plan.

7.4 Opt-Out

You can cancel SMS service at any time. Simply text STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any message you receive from us. After you send a STOP message, we will send you a single reply message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, you may opt in through Enkidu as you did the first time and we will start sending SMS messages to you again.

7.5 Help

If at any time you need assistance or have questions about our text messaging program, text HELP to any message you receive from us, or contact us through the support channels provided in the application.

7.6 Carrier Disclaimer

T-Mobile, AT&T, Verizon, and other mobile carriers are not liable for delayed or undelivered messages. We are not responsible for any delays in the delivery of text messages, as delivery is subject to effective transmission from your mobile carrier. Carriers may impose message or charge limitations on your account that are beyond our control.

7.7 Supported Carriers

Our messaging service is compatible with major US carriers including AT&T, Verizon, T-Mobile, Sprint, and other supported carriers. Carriers are not responsible for any undelivered messages.

7.8 Privacy

Your use of our SMS messaging program is also subject to our Privacy Policy, which describes how we collect, use, and protect your mobile information. We will not share, sell, or trade your mobile phone number or SMS opt-in data with third parties or affiliates for marketing or promotional purposes.

8. Intellectual Property

The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Third-Party Services

Our service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

10. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service will immediately cease.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Indemnification

You agree to indemnify and hold harmless our company, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the service or violation of these Terms.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the service after any changes constitutes acceptance of those changes.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
